These Terms of Service ("Terms") govern your use of the Toefje mobile application (the "App") and related services. Toefje is developed by Dutch Philomath ("we", "us", or "our").
By creating an account, accepting these Terms, or using the App, you agree to be bound by them. If you do not agree, do not use the App.
You must be at least 16 years old to use Toefje. By using the App you confirm that you meet this requirement.
You sign in with Apple or Google. You are responsible for keeping access to that account secure and for all activity that occurs under your Toefje account.
You must provide accurate preference information (such as household size, dietary needs, and cooking preferences) so we can personalise your meal plans. You may update or remove this information at any time in Settings.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on a device that you own or control.
Toefje is a dinner planning service. Depending on your plan, the App may help you:
Features, limits, and availability may change over time. We may add, modify, or remove functionality as the product evolves.
Recipe text, ingredient lists, substitution suggestions, and food photography in the App are generated with the help of artificial intelligence.
AI output can be incomplete, inaccurate, or unsuitable for your situation. Toefje does not provide medical, nutritional, or allergy advice. If you have food allergies, intolerances, or medical dietary requirements, always verify every ingredient and preparation step before cooking or serving food to others.
You can report problematic content from within the App.
Toefje offers a free tier with limited recipe generation and optional paid subscriptions ("Toefje Pro") with higher limits and additional features.
Paid subscriptions are processed by Apple (App Store) or Google (Google Play) through RevenueCat. We do not collect or store your payment card details. Subscription price, billing period, renewal, and cancellation are governed by the store through which you purchased. You can manage or cancel a subscription in your Apple ID or Google Play account settings. Deleting your Toefje account does not automatically cancel an active store subscription.
Right of withdrawal for EU consumers: By subscribing to Toefje Pro, you explicitly consent to the immediate performance of the contract and the delivery of digital content. You acknowledge that by using the service (for example, by generating recipes), you lose your 14-day statutory right of withdrawal. Because payments are handled entirely by Apple or Google, any refund requests must be directed to and are governed by the respective app store's policies.
We may change subscription pricing or plan features. Any change applies to new purchases or renewals after notice as required by the applicable store.

We may suspend or terminate access if you violate these Terms or use the App in a way that harms us, other users, or third-party providers.
The App, its design, branding, and our original content are owned by Dutch Philomath or our licensors. AI-generated recipe content created for you is provided for your personal, non-commercial use within the App.
You retain ownership of information you submit (such as preferences and ratings). You grant us a licence to use that information solely to operate and improve the service, as described in our Privacy Policy.
Our Privacy Policy explains what personal data we collect, how we use AI services, and your rights under applicable data protection law. It forms part of these Terms.

You may delete your account at any time in Settings. Deletion is permanent and removes your preferences, meal plans, recipes, grocery lists, and related data from our systems, subject to the retention notes in our Privacy Policy.
If you cannot access the App, you may request deletion by emailing privacy [at] toefje [dot] app from the address linked to your account.
The App and all content are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that recipes will meet your taste, dietary, or safety needs, that the App will be uninterrupted or error-free, or that AI output will always be accurate.
Nothing in these Terms limits rights that cannot be excluded under mandatory consumer protection law, including where you qualify as a consumer in the European Union.
To the fullest extent permitted by law, Dutch Philomath will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill arising from your use of the App.
Our total liability for any claim relating to the App or these Terms is limited to the amount you paid us for Toefje Pro in the twelve months before the claim.
Mandatory liability under applicable law - including for death or personal injury caused by negligence, fraud, or statutory consumer rights - is not excluded.
We may update these Terms from time to time. When we make material changes, we will notify you through the App or by email before the changes take effect. The effective date at the top of this document shows which version applies.
Continued use of the App after the effective date of updated Terms constitutes acceptance. If a material change is to your detriment, you have the right to cancel your subscription and delete your account before the changes take effect.
If you download the App from the Apple App Store or Google Play Store, you acknowledge that these Terms are concluded between you and us, not with Apple Inc. or Google LLC. We, not the app store providers, are solely responsible for the App and its content. The app store providers have no obligation whatsoever to furnish any maintenance and support services with respect to the App.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
If you downloaded the App from the Apple App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you.
These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law rules.
If you are a consumer in the European Union, you may also use any mandatory protections available under the laws of your country of residence. The European Commission provides a platform for online dispute resolution, available at: https://ec.europa.eu/consumers/odr.
Disputes should first be raised with us at support [at] toefje [dot] app. If we cannot resolve a dispute, the competent courts in the Netherlands will have jurisdiction, subject to mandatory consumer forum rules.
